Terms and Conditions (GTC)
My general terms and conditions apply to all services provided by Christiane Kleyna empower2act (hereinafter referred to as Christiane Kleyna) as a trainer, coach and team developer.
1. Terminology
Coaching sessions, seminars, workshops, labs, lectures and events that Christiane Kleyna conducts or for which she is booked are referred to as events. Participants are abbreviated to TN.

2. Services
Christiane Kleyna provides services as a trainer, coach and team developer. Their achievements are described on the website www.christiane-kleyna.de and www.empower2act.com .

3. Contract
The concluded contract is a service contract.
In the case of a company seminar, coaching and workshop, etc., the agreed services are provided on the basis of the data and information provided by the customer.
A specific economic result is not owed. Termination according to § 627 BGB is excluded.
Christiane Kleyna is entitled to use employees, external trainers and employees as well as other vicarious agents to fulfill the contract.

4. Prevention
If Christiane Kleyna is prevented from providing the agreed services due to force majeure, illness or other circumstances for which she is not responsible, she is entitled to make up for the agreed services at an alternative date to be agreed. Customer claims for damages due to the postponement are excluded.

5. Copyrights
The training materials and documentation provided by Christiane Kleyna are protected by copyright. Christiane Kleyna grants the participants (m/f) a non-exclusive right of use for personal use of the training materials and documentation. Other uses, in particular passing on to third parties, duplication (in whole or in part), processing, distribution and sale are not permitted.
The customer is obliged to inform the participants (m/f) accordingly and to oblige them to observe copyrights.
Christiane Kleyna assures that the training materials and documentation provided by her are free of third-party rights.

6. Confidentiality
Christiane Kleyna keeps and treats all information related to the customer, which becomes known to her from the contractual cooperation, as strictly confidential. She is entitled to use the data obtained from the contractual cooperation in an anonymous form for scientific and journalistic purposes. It is also entitled to refer to the activity for the customer for its own advertising purposes.

7. Compensation
The agreed remuneration is due without deduction after invoicing, unless otherwise agreed. Withholding payment and offsetting are only permitted with recognized or legally established customer claims. Christiane Kleyna retains ownership of the delivered training materials and documentation until final payment.

8. Right of Withdrawal
Participants can withdraw free of charge 14 days before the start of the event. If you withdraw up to 10 days before the start of the event, 50% of the event fee will be charged. If the cancellation is made 3 days before the start of the event, 100% of the event fees will be charged, also in the case of no-show. The participant can provide a substitute participant (male/female). Minimum age is 18 years. Cancellation must be made in writing by email or post. The receipt of the declaration of withdrawal by Christiane Kleyna applies.

8. Images
By registering for an event, it is agreed that all rights for any use and publication of personal images of the participants (male/female) are irrevocably transferred, provided these were created during the event. Images of persons in this sense are photos, graphics, drawings or video recordings that clearly depict participants.
Pictures of people that were taken during the event or by a commissioned photographer or that were made available by the participants should be published.
Images may be used in a modified form (in particular electronic image processing) for illustration, advertising purposes and publication on data carriers without any restriction in terms of time, place or content.

9. Jurisdiction
Place of jurisdiction and place of fulfillment is Alzenau. All legal relationships resulting from this contract are exclusively governed by the law of the Federal Republic of Germany.

10. Final Remark
Oral subsidiary agreements were not made. Changes to the contract should be agreed in writing.
Should individual provisions of these General Terms and Conditions be or become invalid, the rest of the contract remains valid. The contracting parties will agree on an appropriate substitute arrangement.
